The Regulatory Framework in Canada

According to the Food and Drugs Act, cosmetics include “any substance or mixture of substances manufactured, sold or represented for use in cleansing, improving or altering the complexion, skin, hair or teeth, including deodorants and perfumes.” This definition is broad and covers everything from skincare products and perfumes to professional-use cosmetics and even handmade items sold locally.

Key Requirements for Cosmetics in Canada

Cosmetic products placed on the Canadian market must:

  • Be properly labelled, with certain information provided in both English and French.

Unlike in the EU, Canada does not require pre-market approval. However, every product must be notified to Health Canada via the Cosmetic Notification Form (CNF) within 10 days of being placed on the market.

Failure to notify can result in products being refused entry or removed from shelves.

The New Rule: Canadian-Based Representative

Since October 9, 2024, Health Canada requires that all non-Canadian manufacturers appoint a Canadian-based representative (also known as the Canadian Responsible Person). This representative is responsible for:

  • Submitting the CNF within 10 days of product launch.
  • Ensuring compliance with all applicable regulations.
  • Acting as the primary contact point with Health Canada.

This update aligns Canadian law with international practices and strengthens consumer protection by ensuring local accountability.
