Understanding Cosmetic Product Classification in the UAE

Correct product classification is the foundation of successful market entry. Under MoIAT definitions, cosmetic products are substances or mixtures intended to come into contact with external parts of the human body, including skin, hair, nails, lips, and oral mucosa, with the purpose of cleansing, perfuming, changing appearance, protecting, or maintaining good condition.

However, classification is not determined by formulation alone. Product claims are decisive. Any claim related to disease treatment, prevention, or physiological modification may shift a product into the category of medicinal products, medical devices, or other regulated product groups. Misclassification often leads to registration delays or rejection, making expert review essential.

Products Excluded from Cosmetic Classification

In the UAE, several product types are clearly considered non-cosmetic. These include treatments for acne, eczema, psoriasis, rosacea, products targeting damaged capillaries, solutions for heavy or swollen legs such as varicose veins, and treatments for hair loss or alopecia. Identifying these boundaries early helps avoid regulatory risk and unexpected compliance issues.

Registration with Dubai Municipality and MoIAT

All cosmetic products must be registered with the Dubai Municipality Health and Safety Department (HS-D) prior to being sold or distributed. Once approved, products receive a registration certificate valid for five years, as well as a MoIAT conformity certificate. Depending on formulation and intended use, products are classified as low-risk, medium-risk, or high-risk, which directly impacts review depth and testing requirements.

In addition, some cosmetic products must comply with Halal requirements, ensuring that ingredients do not conflict with Islamic law, such as alcohol or pork-derived substances.

Documentation, Timelines, and Post-Market Obligations

The registration process requires a comprehensive technical dossier, including product images, artwork, Free Sale Certificate, Certificate of Analysis, ingredient list, GMP certificate, PIF file, laboratory test reports, product samples, and a Safety Assessment Report.

Standard registration timelines are approximately 40 working days, with an additional 20 working days if laboratory testing is required. After approval, companies must comply with post-market surveillance obligations, including adverse event reporting, notification of formulation or labeling changes, and cooperation with corrective actions if required.
