Imported cosmetics, however, cannot be sold until they are registered with the Central Drugs Standard Control Organization (CDSCO).<\/p><p>Brands that prepare registration, labels and documents in advance avoid customs holds and last-minute packaging changes. This guide walks through the process from the legal basis to life after approval.<\/p><h3 class=\"wp-block-heading\" id=\"the-legal-basis\">The legal basis<\/h3><p>Two instruments govern cosmetics in India:<\/p><ul class=\"wp-block-list\"><li>the <strong>Drugs and Cosmetics Act, 1940<\/strong>, which covers safety, import, distribution and sale<\/li>\n\n<li>the <strong>Cosmetics Rules, 2020<\/strong>, which set out registration, import, manufacturing and labelling requirements<\/li><\/ul><p>Imported cosmetics are registered with the Central Licensing Authority through CDSCO. Indian manufacturers follow a separate route and need a State Manufacturing Licence. Compliance with EU, UK or US rules does not replace an India-specific review. A useful starting point is an overview of <a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/ceway.eu\/international-services\/cosmetic-regulations-india\/\">CDSCO cosmetic registration<\/a> for imported products.<\/p><h3 class=\"wp-block-heading\" id=\"is-your-product-a-cosmetic-under-indian-law\">Is your product a cosmetic under Indian law?<\/h3><p>Indian law defines a cosmetic as an article applied to the body for cleansing, beautifying, promoting attractiveness or altering appearance. Skincare, makeup, shampoos and conditioners, fragrances, soaps and nail products usually qualify.<\/p><p>Claims can change the picture. Products that may be treated as drugs rather than cosmetics include:<\/p><ul class=\"wp-block-list\"><li>creams claiming to cure acne<\/li>\n\n<li>hair regrowth or anti-baldness products<\/li>\n\n<li>anti-dandruff or medicated shampoos with treatment claims<\/li>\n\n<li>skin lightening products claiming to treat melasma or pigmentation<\/li>\n\n<li>sunscreens claiming to prevent skin cancer<\/li>\n\n<li>anti-fungal or anti-bacterial creams<\/li><\/ul><p>Check the claims on labels, websites and marketplace listings before you apply.<\/p><h3 class=\"wp-block-heading\" id=\"appointing-an-authorised-indian-agent\">Appointing an Authorised Indian Agent<\/h3><p>A manufacturer based outside India must authorise a local agent, or its own subsidiary registered in India, to handle compliance. The agent files the registration, acts as the responsible person and manages post-market actions such as withdrawals and recalls.<\/p><p>The authorisation itself must be authenticated, either before a magistrate in India or in the country of origin. Because the agent holds this role for as long as the products are on sale, choose it as part of the market-entry strategy, not just to get the application filed.<\/p><h3 class=\"wp-block-heading\" id=\"what-goes-into-the-application\">What goes into the application<\/h3><p>Applications are submitted online through CDSCO&#8217;s SUGAM portal on Form COS-1. A typical file contains:<\/p><ul class=\"wp-block-list\"><li>manufacturer name, address and contact details<\/li>\n\n<li>details of the authorised agent or importer<\/li>\n\n<li>list of brands, products and variants<\/li>\n\n<li>manufacturing licence from the country of origin<\/li>\n\n<li>Free Sale Certificate from the country of origin<\/li>\n\n<li>formulations and product specifications<\/li>\n\n<li>testing methods and safety information<\/li><\/ul><p>Keep product names, formulas and artwork consistent across every document. Small mismatches are a common trigger for clarification requests.<\/p><h3 class=\"wp-block-heading\" id=\"ingredient-and-quality-checks\">Ingredient and quality checks<\/h3><p>Imported cosmetics must meet safety specifications under the Ninth Schedule or equivalent standards. They must avoid ingredients banned in India and stay within limits for heavy metals and microbiological load.<\/p><p>Run this check before producing stock for India. That leaves time to reformulate or to obtain test data if something does not pass.<\/p><h3 class=\"wp-block-heading\" id=\"labels-for-the-indian-market\">Labels for the Indian market<\/h3><p>Labels must comply with CDSCO labelling rules and with Legal Metrology requirements. Expect to show:<\/p><ul class=\"wp-block-list\"><li>product name<\/li>\n\n<li>manufacturer and importer details<\/li>\n\n<li>batch number<\/li>\n\n<li>manufacturing and expiry dates<\/li>\n\n<li>net quantity<\/li>\n\n<li>directions for use<\/li>\n\n<li>ingredient list<\/li>\n\n<li>country of origin<\/li><\/ul><p>Claims must stay within cosmetic territory. Review artwork before printing, because labelling errors are one of the most frequent causes of customs delays.<\/p><h3 class=\"wp-block-heading\" id=\"how-long-registration-takes\">How long registration takes<\/h3><p>CE.way puts a complete registration at around 60 working days once all documents are in, with about 20 more working days if laboratory testing is required. CDSCO clarification requests and changes to its processing system can extend this.<\/p><p>Avoid fixing retail dates, booking campaigns or shipping large volumes until the application is well advanced.<\/p><h3 class=\"wp-block-heading\" id=\"after-the-certificate-is-issued\">After the certificate is issued<\/h3><p>Registration is the start of ongoing compliance. Keep documents current, route formula and label changes through the agent, and have a process ready for complaints, withdrawals and recalls.<\/p><p>Brands that plan to add products should turn the steps above into a repeatable workflow: classification, formula check, artwork review, dossier, submission.
